Green Card Options: EB-2 NIW vs EB-3 vs H1B

Most guides compare these three as if they sit on the same shelf. They don't.H1B is a temporary work visa. EB-2 NIW and EB-3 are green card categories. You can hold an H1B while an EB-3 petition moves through the queue.
You can file an EB-2 NIW with no employer at all. Comparing them side by side only makes sense once you know which question you are actually answering: how do I stay employed and in status, or how do I get permanent residence.
This guide answers both, in the order that matters.
EB-2 NIW vs EB-3 vs H1B: The Short Answer
Quick version:
- No employer, strong documented impact? EB-2 NIW.
- Employer willing to sponsor, ordinary professional profile? EB-3 (or standard EB-2 with PERM).
- Need to legally work in the US next year? H1B, and the green card question comes after.
The rest of this guide is about the parts that decide outcomes: your country of birth, your evidence, and your clock.
First: H1B Is Not a Green Card Path, It Is a Bridge
An H1B buys you time. Three years, extendable to six, longer if an I-140 is approved and you are stuck in a backlog. That time is what a green card petition needs.
This matters because the sequencing question ruins more cases than the category question. If you are on OPT and burn your unemployment days arguing about NIW versus EB-3, you lose status before either petition is filed.
Post-completion OPT allows 90 days of unemployment. STEM OPT adds 60 more, for 150 total. On H1B after a layoff, you get a 60-day grace period.
Neither EB-2 NIW nor EB-3 fixes a status problem inside those windows. Employment does.
So the working order is: status first, employer second, category third.
What Changed for H1B in 2026
Two things, and one is still moving.
Wage-weighted selection is live. The final rule replacing the flat random lottery with a wage-weighted selection process took effect on February 27, 2026, layered on top of the beneficiary-centric framework.
Selection odds now vary by the wage level of the offered role, which materially favors more senior, higher-paid positions while preserving eligibility across all wage levels.
Practically: entry-level Level I roles are the hardest to get selected on, and a Level III or IV offer is now a selection strategy, not just a salary preference.
The $100,000 fee is in legal limbo. Presidential Proclamation 10973, signed September 19, 2025, imposed a $100,000 fee on new H-1B petitions for beneficiaries outside the United States, effective September 21, 2025.
On June 8, 2026, the U.S. District Court for the District of Massachusetts vacated the fee as an unconstitutional tax, and on July 24, 2026, the First Circuit denied the government's request to stay that ruling, so the fee is currently not collectible.
Separately, DHS has proposed a new $103,265 fee through formal rulemaking, and the original proclamation is set to expire September 20, 2026 unless the administration renews it.
Two takeaways that survive whatever the courts do:
- The fee was written for petitions filed for workers outside the US. A change-of-status filing such as F-1 to H-1B was designed to sit outside the fee's scope regardless of litigation. If you are already in the US, favor change of status over consular processing where you have the choice.
- Verify the fee status on USCIS.gov on the day of filing. This one has reversed more than once in twelve months.
What EB-2 NIW Actually Requires
NIW is a self-petition that skips PERM. No employer, no labor certification, no job offer. That freedom is the entire appeal, and it is also why the evidence bar is high.
You need two things stacked:
1. EB-2 eligibility. An advanced degree, or a bachelor's plus five years of progressive experience, or exceptional ability.
2. A qualifying endeavor under the three Dhanasar prongs:
- Your proposed work has substantial merit and national importance.
- You are well positioned to advance it.
- On balance, it benefits the US to waive the job offer and labor certification requirements.
Who NIW Actually Fits
NIW is most common for researchers, postdoctoral scientists, physicians in underserved areas, entrepreneurs in critical industries, and STEM PhDs.
But the title is not the test. A software specialist and a physician satisfy the same Dhanasar prongs; only their evidence sets differ.
An academic speaks to the prongs through citations and peer review, an entrepreneur through job creation and investment.
A working self-check. You likely have an NIW case if you can produce three or more of these with documentation:
- Publications with independent citations, or patents in force
- A shipped system, open-source project, or product with measurable adoption numbers
- Revenue, funding, or jobs created that you can tie to your specific work
- Invited talks, standards body participation, or peer review assignments
- Letters from people who used your work and were not your manager or co-author
- Press, industry awards, or government or agency adoption
If your strongest evidence is "I have a master's degree and six years at a well-known company," that is an EB-3 or standard EB-2 profile, not an NIW profile.
The 2026 Reality: NIW Got Harder
This is the part most comparison posts skip.
EB-2 NIW filings went from 21,973 in FY 2022 to 66,276 in FY 2025, roughly a 200% increase, and USCIS adjudicators responded with stricter standards and more subjective final merits determinations.
The approval rate followed. For the third quarter of Fiscal Year 2026, April to June 2026, USCIS approved 55.3% of adjudicated EB-2 NIW petitions, the third straight quarterly increase from the 35.7% low in Q4 FY 2025, but still well below the 95.7% rate seen in 2022. Across the first half of FY 2026 the figure was 45.5%.
Read that correctly, because the number is easy to misuse. The published rate blends every petition USCIS reviews, including weak and incomplete ones. A well-documented case that clearly meets the Dhanasar standard is evaluated on its own merits, not against the average.
The most common denial reasons are failing to show the work has national importance rather than local or personal value, weak evidence that you are well positioned to carry the work forward, generic recommendation letters that do not address the Dhanasar prongs, and leaning on degrees or titles instead of measurable impact.
Timeline and cost: Standard I-140 processing runs roughly 14 to 19 months at the Texas and Nebraska Service Centers. Premium processing reduces that to 45 business days for $2,965 as of March 1, 2026, which buys a timely response, not an approval, since USCIS may still issue an RFE inside that window.
What EB-3 Actually Requires
EB-3 is the broad, employer-driven path. It covers skilled workers with at least two years of training or experience, professionals with a US bachelor's degree or foreign equivalent, and other (unskilled) workers, and all three usually require PERM labor certification.
The eligibility bar is low. The process bar is not.
The EB-3 sequence:
- Prevailing wage determination. Employer files ETA-9141 with DOL.
- Recruitment. The employer runs a real recruitment campaign to test the US labor market.
- PERM (ETA-9089). DOL certifies that no qualified US worker is available.
- I-140. Employer petitions USCIS. Your priority date is locked at PERM filing.
- Wait for the visa bulletin. This is where the years go.
- I-485 or consular processing. Once your priority date is current.
Steps 1 through 4 are usually 12 to 24 months depending on DOL queues and audits. Step 5 depends entirely on where you were born.
EB-3 fits you if: you have a permanent full time job offer, your employer has an immigration budget and a track record of filing, and your profile does not carry a national-interest argument. If an employer is ready to sponsor you and your profile does not carry a national interest argument, standard EB-2 or EB-3 is more realistic.
The Country-of-Birth Reality Check
Nothing in this comparison matters as much as your country of chargeability. Here is where the categories actually stand in the September 2026 visa bulletin (final action dates):
EB-2 Worldwide remains current, EB-2 China holds on September 1, 2021, and EB-2 India is unavailable through September 30, 2026. EB-3 Worldwide holds a cutoff of September 1, 2024 and EB-3 China holds January 1, 2022. EB-3 India remains at January 1, 2014, and EB-2 India availability resets with the start of FY 2027 on October 1, 2026.
Three things follow from that table.
If you were born outside China or India: EB-2 is current. NIW approval gets you to a green card quickly. EB-3 has a modest queue. Your bottleneck is petition approval, not the wait.
If you were born in India: EB-2 India hit its annual cap and the State Department announced it was unavailable for the remainder of FY 2026, with beneficiaries advised to have adjustment packages ready the day October availability is announced. An NIW approval still locks a priority date, which still matters enormously, but it does not shortcut the queue. EB-3 India at a 2014 cutoff means an EB-3 filed today is a decade-plus proposition. This is why EB-1A is worth evaluating in parallel for Indian-born applicants with strong profiles.
If you were born in China: EB-2 and EB-3 are within about eighteen months of each other. The category choice is more about which one you can actually win than which one moves faster.
One more current-cycle note: the State Department has warned that EB-1 India, EB-2 across all countries, and EB-5 Unreserved may retrogress or become unavailable before the fiscal year closes on September 30, 2026.
The 5-Question Framework to Pick Your Path
Run these in order. Stop at the first one that changes your answer.
Q1. How many days of work authorization do I have left? Under 120 days: your only project is employment. Get an offer. Categories are a next-quarter problem.
Q2. Do I have an employer willing to sponsor a green card, in writing? No: NIW is your only self-directed option. Yes: EB-3 or standard EB-2 is the default, and NIW becomes optional insurance.
Q3. Can I document measurable impact beyond my job description? No: do not file NIW yet. Build evidence for 18 to 24 months first. Yes: NIW is live.
Q4. Where was I born? Outside China and India: NIW approval is close to a green card. India or China: an approval locks a priority date, and you still need a status bridge (H1B, O-1, L-1) for the wait.
Q5. Can I run both? Usually yes. An employer-sponsored EB-3 or EB-2 and a self-filed NIW can run in parallel. Two approved I-140s means you keep the earlier priority date and gain optionality if you change jobs. This is the single most underused move in the whole process.
Three Scenarios That Show How This Plays Out
Scenario 1: F-1 MS graduate, Indian-born, software engineer, 40 days of OPT unemployment used. Category is irrelevant this quarter. The job is the whole game. Target Level III wage roles to improve H1B selection odds under the wage-weighted rule, and filter hard for employers with a filing history. Revisit NIW in year four, once there are patents, scaled systems, or external recognition to point at.
Scenario 2: Postdoc, Brazilian-born, 14 publications, 300+ citations. NIW, filed now, with premium processing. EB-2 Worldwide is current, so approval converts to a green card on a short timeline. No employer conversation needed. No PERM.
Scenario 3: Product manager, Chinese-born, eight years of experience, employer offering sponsorship, no publications. Standard EB-2 with PERM, not NIW. The evidence for a national-interest argument is not there, and a denied NIW costs 14 months. EB-2 China at September 2021 moves faster than EB-3 China, so the standard EB-2 route is the better of the two.
